Warranty

90 day Limited Warranty:

1. ETO Engineering warrants the Product against any defects in materials and workmanship for a period of ninety (90) days commencing on the date of shipment of the Product (“the Warranty Period”).

2. ETO Engineering, PLLC shall replace the Product at no additional charge in the event of a defect in materials and workmanship during the Warranty Period (the “Limited Warranty”).

3. The Limited Warranty shall not cover damage to the Product or part of Product resulting from:

a) Normal wear and tear of the Product;

b) Alteration of the Product;

c) Improper installation of the Product;

d) Physical abuse, misuse, neglect, or accident involving the Product;

e) Use of the Product for a purpose other than its intended purpose;

f) Failure to follow ETO Engineering, PLLC’s instructions concerning proper installation or use of the Product; and

g) The negligence of a person or entity other than ETO Engineering, PLLC in the installation or use of the Product;

4. The occurrence of any event or action set for in Sections 3(a) through 3(d) of the Limited Warranty shall result in the voidance of this Limited Warranty;

5. In the event any Product fails to comply with the foregoing warranty Seller will at its option, either (a) repair or replace the defective Product, or defective part or component thereof or (b) credit Buyer for the purchase price of the Product. The Buyer must obtain shipping instructions from ETO Engineering, PLLC prior to returning any Products under warranty including an return authorization number. It is the Buyer’s responsibility to return the defective Products to ETO Engineering, PLLC at the Buyer’s expense. Ordinary ground transportation charges back to the Buyer will be the responsibility of the Seller.

6. This warranty does not cover failure or damage due to storage, installation, operation, or maintenance not in conformance with Seller’s recommendations and industry standard practice or due to accident, misuse, abuse, or negligence. This warranty does not cover reimbursement for labor, gaining access, removal, installation, temporary power or any other expenses which may be incurred in connection with replacement or repair. This warranty does not apply to equipment not manufactured by Seller. Seller limits itself to extending the same.

7. Except for the warranties set forth in this subsection, ETO Engineering, PLLC hereby disclaims to the maximum extent allowable by law all other express or implied warranties in respect of the Products, including, without limitation, any implied warranties of merchantability and/or fitness for a particular purpose. The express warranties stated above are in lieu of all obligations and liabilities of ETO Engineering, PLLC for damages, including, without limitation, incidental consequential (including, without limitation, loss of profits or loss or destruction of data), indirect, special or exemplary damages that arise in any way out of any defects in the Products or their materials or workmanship.
